FIBRE ARTS FESTIVAL: TERMS AND CONDITIONS OF ENTRY
By booking a ticket and in consideration of being allowed to participate in and attend the Fibre Arts Festival (the “Festival”), which is taking place at Maranatha Recreation Camp, Yandina, Queensland (the “Property”), I agree to comply with any and all rules, regulations, terms, and conditions of the Festival, including but not limited to the following:
Tickets are non-refundable.
We reserve the right to cancel the event due to unforeseen circumstances or viability. If this does happen all ticket holders will be fully refunded, however, we cannot be responsible for refunds of participants’ airfares and associated costs. If this was to occur we will try our very best to make sure there is sufficient communication(s) to you as well as appropriate time to make alternative arrangements.
Travel insurance is required for participants travelling from interstate or internationally to the festival. Travel insurance should provide coverage against trip cancellation, travel interruption, personal accident, personal liability and medical expenses.
I understand and acknowledge that (a) activities at the Festival have inherent dangers that no amount of care, caution, instruction or expertise can eliminate; (b) there are things on the land including creeks, rivers, and trees that may be dangerous; (c) it is my responsibility to exercise due care in my use and enjoyment of the Property and the Festival; (g) the risks inherent in my use of the Property and the Festival may arise as a result of either man-made conditions and/or naturally occurring conditions, and that not all dangerous conditions will be readily apparent, nor marked as dangerous, nor made safe prior to my use and enjoyment of the Property and the Festival; (h) these inherent risks include but are not limited to trips, burns, collisions with other participants and inanimate objects, unknown or hidden facility hazards, natural hazards, uneven and dangerous terrain, wildlife, insect bites, careless behaviour (j) possible injuries include everything from minor muscle soreness, bruises, sprains, abrasions, and lacerations, to more serious injuries. Fibre Arts Festival essentially provides a Festival space, where people can share ideas, information and skills with others and learn and grow together, through activities that include but are not limited to workshop classes as well as nightly evening activities. I understand that the activities involve an element of risk and are not provided by Fibre Arts Festival and that Fibre Arts Festival has no responsibility or liability for any of the activities, and I hereby release Fibre Arts Festival and the released parties for any injuries that I may sustain relating to any of the activities.
I expressly and voluntarily assume all risk while participating in the activities or in any aspect of the Festival. I understand that my use and enjoyment of the Property and the Festival and the Activities involves inherent risks, both those described herein and other risks, that are serious and that may involve dangers regardless of the care taken by Fibre Arts Festival or the Released Parties. I realize my use and enjoyment of the Property and the Festival and participation in the Activities require some degree of skill, coordination, and physical fitness. I have read the previous paragraph and I know the nature of the Property and the Festival and the Activities, understand the demands to be placed upon me relative to my physical condition and skill level, and appreciate the types of injuries that can occur as a result of such activities. I hereby assert that my participation in the use and enjoyment of the Property and the Festival and the Activities is voluntary and that I knowingly assume all inherent risks of the Property and the Festival and the Activities, both those described herein and others presently unknown.
I release and discharge the Released Parties from any and all liability, claims, demands or causes of action that I may hereafter have for any injuries, damages or death arising out of my participation in the Festival and the Activities and use of the Property. I, do hereby release, waive, discharge, and covenant not to sue the Released Parties and hold them harmless from liability for any and all claims arising from my use and enjoyment of the Property and the Festival and the Activities, including any injury resulting from the ordinary negligence of the Released Parties.
By entering the Festival, I, and all participants, agree to the following terms, conditions, and guidelines for the use of any imagery obtained at the Festival, including still photographs and videos. I hereby consent and agree that any images captured by Fibre Arts Festival are able to be used in any and all media worldwide including online, now or hereafter known, and for any purpose whatsoever. I hereby release to Fibre Arts Festival all rights to exhibit this work in print and electronic form for promotional purposes publicly or privately and to market copies.
I understand that children under 18 years of age cannot attend the Festival.
The Fibre Arts Festival reserves the right to remove or prohibit any consumption of alcohol within the event grounds.
I understand that each workshop does have a limited capacity and all efforts are taken to make sure I have my desired selections, but I also understand that this will depend on the facilitators schedule and the availability of my chosen workshops throughout the event.
If, for any reason, a facilitator is unable to attend the festival and it affects one of my selected workshops, Fibre Arts Festival will work with me to reschedule into a similar workshop. This again, depends on availability of that workshop in the overall schedule.
The Festival intends to go ahead, rain or shine however, I agree that Fibre Arts Festival is not liable for acts of God, the weather, strikes, protests, or actions taken by government agencies and similar causes, which may interfere with the Festival. I understand that tickets are nonrefundable even if the Festival is terminated early or canceled, or entry conditions are modified, due to harsh weather, acts of nature, governmental regulation, the failure to obtain required governmental permits, or conditions beyond the control of Fibre Arts Festival.
In the event of a dispute, both parties agree in the first instance, to seek an amicable resolution between themselves. In any instance whereby resolution is deemed ineffective by either party, both parties agree to seek independent mediation to resolve the dispute, where the Mediator is acceptable to both parties. Both parties agree to accept any proposed settlement by the Mediator as full and final.
This Agreement is governed by and construed in accordance with the law in force in the State of Queensland, Australia.
